Motorolla v Microsoft

 Motorolla v Microsoft

Uh-oh, bad things are on the horizon for Microsoft. Recently, Germany has already banned the sales of both Xbox 360's and the Windows 7 Operating system. And that might be getting a tail soon, as International Trade Commission judge David Shaw is hoping to see all import of 360's to the United States  stopped.

Judge Shaw sent his recommendations to the Internation Trade Commission believing that the public interest in enforcing intellectual property rights outweighs any potential economic impact on video game consol buyers.
Shaw wants to see the ITC ban the import of the 4GB and 250GB Xbox 360 consoles and prevent further sales with a cease-and-desist order. Further, Microsoft should post a bond equal to 7% of the value of unsold Xbox 360 inventory already in the country.
Motorolla wanted more, but Microsoft pointed out a few legalaties that prevented this particular motion of seeing the light of day.
If the order comes through, President Barack Obama will have 60 days to review the decision. After that, the only way to appeal is through the Court of Appeals for the Federal Circuit.

And I think it's safe to asume we'll be seeing a next generation of Xbox at e3. Wouldn't you agree?
